General Terms and Conditions (GTC)
1 Scope of application
1.1 These General Terms and Conditions (GTC) apply to all services that come about via the website www.juliaschenkenfelder.com between Julia Schenkenfelder and her customers (hereinafter referred to as the client).
1.2 Deviating or supplementary general terms and conditions of the client are not part of the contract, unless Julia Schenkenfelder expressly agrees to their validity in writing.
2 Provision of services
The client agrees that Julia Schenkenfelder may use affiliated companies or subcontract companies to perform the agreed services.
3. remuneration
3.1 Invoices from Julia Schenkenfelder are due for payment within 7 days of the invoice date.
3.2 Services that are not provided on the basis of the offer, but on a separate express request by the client, will be invoiced at the contractor's usual rates.
3.3 If the parties have not reached an agreement on the remuneration of a separate service, the provision of which the Client could only expect in return for remuneration under the circumstances, the Client shall pay the usual remuneration for this service. In case of doubt, the remuneration rates demanded by the Contractor for the services shall be deemed customary.
3.4 Offers made by Julia Schenkenfelder are non-binding unless their binding nature has been explicitly guaranteed.
3.5 If the client defaults on payment, he shall owe default interest of 7% of the total amount owed from the due date.
4 Delivery and dispatch
4.1 Delivery shall be made to the address specified by the client.
4.2 Unless otherwise stated, the delivery time is approx. 10-14 working days after receipt of payment.
4.3 The shipping costs will be clearly communicated to the client before the binding order is placed and are to be borne by the client.
5 Retention of title
The goods remain the property of Julia Schenkenfelder until full payment has been received.
6 Duration of performance and withdrawal
6.1 The service provision runs over the period stated in the offer and ends with the expiry of the period or with the fulfillment of the service owed. An extension requires a timely agreement between the parties. The agreement on the extension shall be agreed as a supplement to the order.
6.2 Withdrawal may take place for good cause. All services previously provided by Julia Schenkenfelder must be remunerated by the client.
6.3 Declarations of withdrawal must be made in writing.
7 Warranty
The statutory liability for defects applies.

8 Liability
8.1 Julia Schenkenfelder is liable without limitation for intent and gross negligence.
8.2 Julia Schenkenfelder is only liable for simple negligence in the event of a breach of a material contractual obligation (cardinal obligation), the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely. In this case, however, the liability is limited to the foreseeable, contract-typical damage.
9. final provisions
9.1 The law of the Republic of Austria shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
9.2 Should any provision of these GTC be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.
9.3 Amendments or additions to these GTC must be made in writing.
